| Minutes of the Bi-Monthly Town Board Meeting held Tuesday, October 26, 2010, at 5:30 PM, at the Keene Town Hall. The following Town Board Members were present: William B. Ferebee, Supervisor, Paul R. Martin and Marcy A. Neville, Members of Council. Absent: Robert M. Biesemeyer and Lawrence Jaques, Members of Council. Also present were: Bruce Reed, Highway Superintendent and Ellen Estes, Town Clerk.
The Chairman, Mr. Ferebee, called the meeting to order at 5:26 PM.
Resolution No. 203 - 10
Mr. Ferebee offered a resolution and moved its adoption. Be it resolved, that at his request, Stewart Crawford be refunded $450.00 which was overpaid on his 2010 Water Rent, saying the water to his house was not turned on in 2010. This resolution was seconded by Mr. Martin.

There was a brief discussion initiated by Mr. Martin who said he would like to see the Town purchase land nearby to mine road sand.
Mr. Reed said that he looked into this once and found that with mining permits, etc. it was cheaper to buy it.
Mr. Ferebee reported that the audit is moving along.
Mr. Martin initiated a brief discussion regarding the Hurricane Fire Tower. He said although it looks like it is going to be left on location, it is on record that the Town of Keene would like it if it is ever taken down.
The next discussion was in regards to the road needed for access for the Affordable Housing Project.
Ms. Neville said that HAPEC is reluctant to put in the road, not knowing if the Town would take it over.
Mr. Martin suggested taking over the land adjacent by eminent domain. Mr. Reed said he is reluctant to guarantee taking it over saying he has gotten into a mess before doing that. He mentioned the paving, at which time Ms. Neville stated it wouldn't be paved. Mr. Reed said that was a mistake, saying he guarantees one of the residents will complain about the dust. He said he can't agree to take something over that he can't see.
Mr. Ferebee said maybe if the project builds the road to specs, there could be some kind of an agreement in writing regarding the Town taking the road over after 1 year of use.
Mr. Reed suggested the Town buying the area for the road for $1. Mr. Martin asked why it couldn't be kept as a driveway taken care of by the residents.
Ms. Neville said that requires a Home Owners Association which is very expensive to set up.
Mr. Ferebee also spoke of the Town developing fence requirements.

Mr. Ferebee offered a resolution and moved its adoption. Be it resolved, that the following bills be accepted for payment, including those that were prepaid. This resolution was seconded by Mr. Martin.
